In compliance with the laws of the United States (hereinafter referred to as “the Law”), and with the aim of ensuring the protection and privacy of our customers’ personal data, as well as regulating the rights of access, rectification, cancellation, and opposition to the processing of such data, BitsRadar hereby communicates the following notice.

1. The Responsible

BitsRadar (hereinafter referred to as “the Responsible”), located at 900 Linton Blvd Ste 210, Delray Beach, Florida 33444, is responsible for protecting the confidentiality of personal data of all users (hereinafter referred to as “the Data Subject”) and ensuring their privacy. In case some of the mentioned data is not available, it may be possible that the Responsible cannot provide the services related to the legal relationship established with the Data Subject.

Furthermore, it is informed that, to fulfil the purposes set out in this Notice, personal sensitive data described in the previous sections may be collected and processed. Therefore, the Responsible undertakes to treat such data with strict security measures, ensuring its confidentiality.

5. Principles

The Responsible observes the principles of confidentiality, lawfulness, consent, information, quality, purpose, loyalty, proportionality, and responsibility in the protection of personal data.

6. Data Retention

For every Data Subject who registers personal information with us through our website or shares their personal data through other means, it is understood that the data will be retained indefinitely with all the guarantees in this Notice until the Data Subject decides to exercise their right of access, rectification, cancellation, opposition, restriction of use, or revocation of consent by submitting a written request to the email address contact@bitsradar.online.

7. Data Transfer

The Responsible may transfer data without the consent of the Data Subject in cases provided for by Salvadoran law and for lawful purposes. Data transfers to service providers may also occur for the fulfillment of contractual obligations agreed upon, such as payment gateways. Third parties and recipient entities of personal data shall assume the same obligations and responsibilities as the Responsible, as stated in this Privacy Notice, in addition to their own internal data management policies of each service provider of BitsRadar. The Data Subject who establishes a legal relationship with the Responsible accepts that their personal data may be transferred under the terms described in the Law, its Regulation, and this Privacy Notice.

8. Options and Means to Limit the Use or Disclosure of Personal Data

The processing of personal data will be limited to what is necessary, appropriate, and relevant for the purposes stated in this Privacy Notice. The Responsible has the necessary and sufficient security measures—administrative, technical, and physical—to protect personal data against damage, loss, alteration, destruction, unauthorized use or access, or processing.

Personal data is safeguarded in databases and computer systems with the necessary security measures to prevent information leaks. Physical and logical access controls, environmental controls, anti-spam protection systems (IPS, Firewall), antivirus protection tools, and web filtering are some of the measures used to maintain the security of data in the Responsible’s systems.

9. Rights of Data Subjects

Any Data Subject or, where applicable, their legal representative, may exercise their rights of access, rectification, cancellation, and opposition to their personal data. The Responsible will provide the means that allow for the timely exercise of these rights. Requests for access, rectification, cancellation, opposition, restriction of use, or revocation of consent must be made in writing and addressed to the Privacy Department at the email address contact@bitsradar.online.

10. Procedure for Exercising Rights

The request, in writing via email, for access, rectification, cancellation, opposition, restriction of use, or revocation of consent must include and be accompanied by the following:

The Responsible will inform the Data Subject, within twenty business days from the date the request for access, rectification, cancellation, or opposition is received, of the decision made. If the request is approved, the Responsible will implement it within fifteen business days from the date of communication. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances justify it.

11. Access

The obligation to provide access to information will be considered fulfilled when the personal data is made available to the Data Subject.

12. Revocation

The Data Subject may revoke their consent for the processing of personal data at any time by submitting a written request to the email address contact@bitsradar.online.

Within twenty business days from the date the revocation request is received, the Responsible will inform the Data Subject about its acceptance or refusal. If the revocation is accepted, the Responsible will implement it within fifteen business days from the date of communication to the email address provided by the Data Subject.

13. Changes to this Notice

The Responsible reserves the right to make modifications or updates to this privacy notice at any time to comply with legislative or jurisprudential novelties, internal policies, or new requirements for the provision or offering of the services provided by the Responsible.

14. General Consent

By having been provided with this Privacy Notice and its modifications, either in person or through the website or other means, and without immediately expressing any opposition, it will be understood that the Data Subject has implicitly consented to the processing of their data. If the Data Subject provided their data verbally, in writing, electronically, optically, or through any other technology or unequivocal signs, it will be deemed that they have given their express consent.

15. Express Consent

In accordance with the applicable articles of the Federal Law for the Protection of Personal Data Held by Private Parties, by means of this document, the Data Subject: i. Acknowledges having read this Privacy Notice and understood its scope; ii. Expressly consents to the processing of their personal data and sensitive personal data as described in this Privacy Notice; and iii. Agrees that the Responsible may transfer their personal data and sensitive personal data to third parties other than the Responsible. This express consent may be documented through a handwritten signature, electronic signature, or any authentication mechanism.
